1. Introduction
Welcome to Hearth & Home, a curated online retailer of premium furniture, home appliances, and related accessories. These Terms & Conditions ("Terms") govern your purchase of products from our store, your use of our website (the "Site"), and all interactions with our brand, including our design consultations, Trade Program, and white-glove delivery services. By using our services and placing an order, you agree to be bound by these Terms.
2. Eligibility
To place an order with Hearth & Home, you must be at least 18 years of age and possess the legal authority to enter into a binding contract. You affirm that you will use our Site and services only for lawful purposes and in accordance with all our policies.
3. Account and Client Responsibilities
You, the client, agree to provide current, complete, and accurate account, billing, and shipping information for all purchases. Providing a correct delivery address and contact number is critical for scheduling and completing your delivery. It is your responsibility to ensure that the delivery path (doorways, hallways, staircases) is clear and large enough for the items ordered. We reserve the right to refuse or cancel any order if we suspect fraudulent activity or if delivery information is incomplete or inaccurate.
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. The individual who places the order is considered the primary responsible party for that transaction.
4. Product Representation and Natural Materials
Many products sold by Hearth & Home are crafted from natural materials like solid wood, stone, and genuine leather. We make every effort to display our products as accurately as possible through high-quality photography and detailed descriptions. However, you acknowledge that for items made from natural materials, minor variations in wood grain, color, stone veining, and texture are inherent characteristics of the material and are not considered defects. These variations are a hallmark of authenticity and quality. An order is not confirmed until you receive an official order confirmation email from Hearth & Home.
5. Fees, Pricing, and Payment
All product prices are listed in US Dollars ($) and are exclusive of any applicable sales tax, which will be calculated at checkout based on your shipping address. Shipping fees, including any white-glove service charges, are also calculated at checkout. Full payment is required at the time of order unless a financing option is selected and approved through our third-party partner. Prices for our products are subject to change without notice.
6. White-Glove Delivery, Installation, and Receipt of Goods
You are responsible for being available during the scheduled delivery window. For appliance installations, it is your sole responsibility to ensure that the installation site is prepared in advance with code-compliant and compatible electrical, plumbing, and/or gas connections. Our delivery team cannot perform any structural, electrical, or plumbing modifications. Upon completion of delivery and assembly/installation, you or your designated representative will be asked to inspect the items and sign a proof of delivery. This signature confirms that you have received the items in good condition. Hearth & Home is not liable for any damage to products or property reported after the delivery team has departed and the proof of delivery has been signed.
7. Cancellations, Returns, and Damage Policy
You may cancel a standard, in-stock order for a full refund at any time before it has been processed for shipping. For all custom and made-to-order items, cancellations are only possible within 48 hours of placing the order; after this window, the order is final and cannot be canceled or refunded. For eligible in-stock items, we accept returns within 30 days of receipt. Items must be in their original, unused condition. The client is responsible for all return shipping costs, and a restocking fee of 15% will be applied. In the event an item arrives damaged, this must be noted on the proof of delivery form before the delivery team leaves. If concealed damage is found, you must contact our Customer Experience Team within 3 days of delivery with photos. At our discretion, we will arrange for a professional repair, a replacement part, or a full replacement.
8. Intellectual Property
The "Hearth & Home" name, logo, website content, text, product photography, and all related service names and brand assets are the exclusive intellectual property of Hearth & Home LLC. We grant you a limited, non-transferable license to access and use our Site for personal, non-commercial use. Any unauthorized use, reproduction, or distribution of our brand assets or Site content is strictly prohibited.
9. Limitation of Liability
You agree not to use our Site for any unlawful purpose or to post any content that is defamatory, obscene, or infringing. In no event shall Hearth & Home, its directors, employees, or affiliates be liable for any indirect, incidental, or consequential damages. Our total liability in connection with any product purchased through our Site is strictly limited to the purchase price of that product.
10. Applicable Law
These Terms are governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law principles. In the event of any dispute arising from these Terms, the courts of New York County, New York, shall have exclusive jurisdiction.
11. Policy Updates
We reserve the right to update or modify these Terms & Conditions at any time without prior notice. The revised Terms will be posted on our Site, and the "Last Updated" date will be amended. Your continued use of our services after any such changes are posted constitutes your acceptance of the new Terms.
